Look Again Terms and Conditions
The information below is applicable to workshops, courses, training, projects, photography commissions and other work undertaken by Look Again.
A copy of the terms and conditions will be provided with all quotations and must be agreed prior to work starting. Payment of any advance fees or payments online will be an acceptance of the terms and conditions. Terms are available on our website for reference.
2 Our Fees.
Charges for services are clearly set out on our website or workshops, courses, training, projects, photography commissions and other work quotations and these are sent to the Client via e-mail. Quotations are valid for a period of 30 days unless alternate timescales have been agreed beforehand with the Client. Look Again reserves the right to decline or adjust a quotation after the valid timescale has expired.
All projects require a fifty (50) percent deposit of the total cost quoted and must be paid in advance, prior to work commencing. The remaining balance will become due on the completion of the workshops, courses, training, projects, photography commissions and other work and prior to any artwork release.
Payment for services is accepted by bank transfer, cheque or online payment. Cheques should be made payable to Look Again and sent to 60 Westward Road, Stroud, Gloucestershire, GL5 4JA.
3 Client Photographs Review.
For photography commissions, the client shall assist and cooperate with Look Again in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed; Look Again shall not be responsible for photographs not taken as a result of the client’s failure to provide reasonable assistance or cooperation.
The Client will have the opportunity to review an agreed selection of edited watermarked photographs prior to the final invoice being submitted them. Once agreed, the client will be sent high resolution versions of the agreed photographs. On completion of a commission the photographs shall be deemed accepted and approved by the Client, unless Look Again is notified otherwise and within ten 7 days of the date they are made available to the Client.
Invoices are sent to the Client prior to the commencement of a project. Invoices are typically sent digitally via email; however, the Client can request hard copy invoices. Invoices are due within fourteen (14) days of receipt, after which a reminder will be sent to the Client. If the invoice has not been settled after thirty (30) days then Look Again will consider the account to be in default. Late Payment Interest will be charged under the Late Payment of Commercial Debts (Interest) Act 1998 at the rate of 8.5% and compensation will be claimed arising from late payment under section 5A of the Late Payment of Commercial Debts (Interest) Act 1998.
5 Project Termination.
Termination of a project by the Client must be requested in writing or via email and will be effective on receipt of such notice. Telephone requests for the termination of services will not be honoured until and unless confirmed in writing or via email. The Client will be invoiced for work completed to the date of first notice of cancellation for payment in full within thirty (30) days.
Ruth Davey from Look Again maintains full copyright of all photographs taken. The Client will be granted usage rights to use photographs for specific purposes in the quote. Third parties may not use the photographs, unless prior permission from Look Again is given.
7 Completion of work.
Look Again will aim to complete the work within 10 working days of the photography shoot. If for any reason Look Again is not able to do this, the Client will be informed as soon as is practicable.
8 Photo permissions.
In the case of a workshop, training or course setting, Look Again will ask participants for consent to take photos of them for monitoring, evaluation and/or promotional reasons. If a participant declines to give permission Look Again will respect this.
In the case of photography commissions, the Client agrees to grant Look Again permission to use any photographs taken for promotional reasons and for possible resale.
In the case of a photography commission involving vulnerable clients of the Client, The Client will be responsible for ensuring photo permissions are given for all represented in the photographs. E.g. a charity working with people living with dementia needing promotional photographs of their clients will ensure that permissions have been given.
These Terms and Conditions supersede all previous representations, understandings or agreements. The Client's signature generated digitally, written and posted or scanned, photographed and emailed to us, or payment of an advance fee constitutes agreement to and acceptance of these Terms and Conditions. Online payment is an acceptance of our terms and conditions.
10 Governing Law.
This Agreement shall be governed by English Law.
